Welcome to Studio 88. By accessing our website or engaging our services, you agree to be bound by these Terms of Service. These terms govern your use of our website and any branding, design, development, AI, automation, consulting, or creative services provided by Studio 88.
1. Services
Studio 88 provides creative and digital services including, but not limited to, brand identity, graphic design, website design and development, AI integration, workflow automation, consulting, content creation, and related digital solutions. The scope, timeline, pricing, and deliverables for each project will be outlined in a separate proposal, invoice, agreement, or written communication.
2. Payments
Payment terms are specified in each project proposal or invoice. Unless otherwise agreed, invoices are due according to the terms stated on the invoice. Project work may be paused until payment has been received. Deposits and payments made for completed work are non-refundable unless otherwise agreed in writing.
3. Project Timelines
Estimated timelines are provided in good faith but may vary depending on project complexity, client feedback, revisions, or unforeseen circumstances. Clients agree to provide requested materials, approvals, and feedback in a timely manner to avoid delays.
4. Client Responsibilities
Clients are responsible for providing accurate information, project requirements, and any necessary assets required to complete the project. Clients also represent that they own or have permission to use all materials, including logos, images, text, trademarks, and other content supplied to Studio 88. Clients agree to use all deliverables in compliance with applicable laws and regulations.
5. Intellectual Property
Upon receipt of full payment, ownership of the final approved deliverables created specifically for the client transfers to the client unless otherwise stated in writing. Studio 88 retains ownership of preliminary concepts, unused designs, internal processes, templates, tools, and methodologies developed during the course of a project. Unless otherwise agreed, Studio 88 reserves the right to display completed work within its portfolio, website, social media, and marketing materials.
6. Project Suspension or Termination
Studio 88 reserves the right to suspend or terminate services if payments become overdue, if a client engages in abusive, unlawful, or inappropriate conduct, or if continued work becomes impractical due to circumstances outside of Studio 88's reasonable control. Any completed work up to the date of termination remains billable.
7. Limitation of Liability
Studio 88 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services. Our total liability shall not exceed the amount paid by the client for the specific services giving rise to the claim. All services are provided on an "as-is" basis without warranties except where required by applicable law.
8. Changes to These Terms
Studio 88 may update these Terms of Service from time to time. Updated terms will be posted on this page with a revised Effective Date. Continued use of our website or services constitutes acceptance of the revised terms.
9. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
